A complete estate plan provides for the management of your personal well-being and management and distribution of your financial assets in the event of your incapacity or death. An effective estate plan is comprised of (1) a Revocable Living Trust to manage your assets in the event of your incapacity and/or death, (2) a Short-form Trust outlining the Successor Trustees of your trust and their powers without revealing the identity of your trust’s beneficiaries; (3) a Last Will and Testament to outline your funeral plans, select your personal representatives, select guardians for your minor or incapacitated children, and distribute assets held in your own name to your trust upon your death, (4) a Durable Power of Attorney for selecting Agents to manage and distribute assets held in your own name to your trust while you are still alive but incapacitated, and (5) an “Advance Health Care Directive” to select the persons responsible for making health-care decisions for you in the event of your incapacity.
The process begins with completing the intake questionnaire (attached below) which requests information regarding your assets, asks you to name your beneficiaries and identify those who will hold the positions of Successor Trustees for your Trust, Personal Representatives for your Last Will and Testament, Attorney-in-Fact for your Power of Attorney for financial decisions, Guardians for your children, and Agent for your Advance Health Care Directive. Please note that the form allows you to decide whether you should distribute your assets via a Revocable Living Trust or a Will (however, even with a Trust-based plan, a Will is required). Please contact our office should you have any questions regarding the Will vs. the Trust.
This process helps to eliminate uncertainties over the administration of your estate while maximizing the value of your estate by reducing taxes and by eliminating the need for probate administration of your estate and the associated publicity and expenses. A properly organized estate plan makes a fine gift to your family and other loved ones, and is a testimonial to your concern and care for their well being.
